PHOENIX — Attorneys for the Independent Redistricting Commission are asking a federal court to dismiss what they contend is a power grab by state lawmakers.

Legal papers filed late Friday in federal court acknowledge there was a loss of power by the Legislature in 2000 when voters approved creating the commission and gave it the power to draw the lines for congressional and legislative districts. But Mary O’Grady said that does not make the system illegal.

“That was the intent,’’ she wrote.

O’Grady said the leaders of the Legislature, who are trying overturn at least part of the 2000 initiative, are “concerned more with the loss of power than the will of the people who elect its members.’’

The filing comes as Ray Bladine, the commission’s executive director, said lawmakers need to allocate at least another $1.25 million for the balance of this budget year that runs through June 30. And the big cost is defending three lawsuits against the commission, including this one filed by the Legislature.

Bladine said the request should be no surprise. He pointed out that the commission asked for an extra $2.23 million earlier this year but got just $1.12 million.

Hanging in the balance is who divides Arizona into its nine congressional districts.

Lawmakers are asking the three-judge panel to immediately overturn the part of the voter-approved measure that lets the commission draw those lines. That would free the Republican-controlled Legislature to redraw the lines before the 2014 race — a move that likely would upset the current 5-4 edge that Democrats hold in the state’s congressional delegation.

Central to the question is a federal constitutional requirement saying the times, places and manner of holding elections for federal lawmakers “shall be prescribed in each state by the Legislature thereof.’’ That was the way the lines were drawn in Arizona through the 1990 redistricting.

The 2000 vote gave that power to the five-member commission. Proponents argued that would be less political than having lawmakers create districts designed to benefit themselves and their allies, to the disadvantage of political foes.

Republican legislative leaders sued last year to reclaim the power to at least draw the congressional lines, citing that constitutional language. They contend that provision allows the elected Legislature — and only the elected Legislature — to do that work.

But O’Grady said in the latest court filings the legislators are reading too much into that language. She reads it instead as an allocation of power between the states and the federal government.

“It’s talking about the legislative power of the state,’’ O’Grady said. “It’s up to the state to define how it’s going to exercise its legislative power.’’

In Arizona, O’Grady said, our state constitution gives that power both to the people and the Legislature.

“And the people established the commission to exercise legislative power over redistricting,’’ she said.

Besides, O’Grady said, if the Legislature doesn’t like this system, “It is free to make and pass a new plan and submit it to the voters.”

House Speaker Andy Tobin, who is making a bid for Congress, and is one of the movers behind this lawsuit, had a plan to do that, but could not get it approved.

Further, O’Grady said the challenge by legislators comes too late — not just because the current process has been in place since the 2000 election, but because the Legislature was allowed to provide input into the maps crafted by the commission but chose to sue only after a majority of lawmakers did not like the final results

1. Gerrymandering is when the political party in power redraws districts in their favor by various methods of bundling or dividing voting districts. This can lead to some crazy looking districts drawn.
2. I don't think it is unconstitutional but maybe it should be made illegal and instead be drawn by geography and voting population, as I think it makes part of this voting process grossly unfair among the political parties.
3. Gerrymandering is really only good for the party in power, for as long as they continue to correctly redraw the districts in their favor, they will win consecutively, and remain the party in power.
4. I don't think it offers people fair representation because they have no say in what district they are put in nor can they control how the districts are drawn. It really is only good from the point of the politicians because they really don't have any legal challenge as to how they draw districts.
5. People can stop gerrymandering by writing letters to their congressmen and to other people in government and let their view be told.
6. I suppose gerrymandering is a bad thing because it is just a political tool used by politicians to stay in power. There is no check on the power and its uninfluenceable by the voters.

Gerrymandering is the process by which the states are divided into districts to determine the number of representatives that will sit in the H.O.R. For said state.
I am pretty positive this process is not unconstitutional and needs to happen, in a world such as our changes must always be made.
This process is best for which ever political party who has the power, other than that no one really gains much from it.
I see both sides of this arguement for and against gerrymandering. My opinions remain anonymous.

2. I don't think it is unconstitutional but maybe i dont believe we should do it, for our states dont need to be messed with. change is always good, but for some reason this reminds me of the beggining to the hunger games... so again i do not like it.

1. A gerrymandering is when a political party moves the district lines in order to sway the vote in their favor.
2. I believe that it is unconstitutional because they political parties are changing the district voting lines but the people don't get a say in if they want their lines to be moved or not. Also by changing the lines the political parties are about to change the outcome in their favor.

4. No I don't believe that it offers fair representation of the people because if the lines get changed the people don't even get a say in they want it to be changed or if they like their district just the way it is.

Gerrymandering is the process of our nations majority party drawing our states district lines in order to benefit themselves. It isnt necessarily unconstitutional since in most cases this system will represent the districts even better than before. The main concern is that is benefits one party more and can be used to dominant the legislatives leading party. It does fairly represent the people when they try to put certain supporters together in a district line makeup. Now if most people have a problem with it then they can vote against it in state legistature conventions. This system is not correct when its used to benefit the party and only joins people in a district for their race and factors like that, otherwise this system could be used better to make representation even more precise.

Gerrymandering is the process in which politicians redraw electoral district lines in order to create a “safe” district for their party. The process is neither illegal or unconstitutional, but it is extremely unfair. Gerrymandering only benefits the political party that is power because it gives them an unfair advantage over the rival party. It is also unfair to U.S. citizens. Instead of the people having the ability to choose their representative, Gerrymandering creates a situation in which the politicians basically get to choose who votes for them. The process of Gerrymandering and the idea behind it is wrong because it is taking power and representation away from the people and giving more power to the politicians. In order to put an end to Gerrymandering, the people must not be afraid to voice their opinion and protest against it.

People living in different areas may need different things then the people on the other side of the state. So when weird district lines are drawn it hurts those who need different things.
5- people could possibly stop gerrymandering by consulting their state legislature or by sending letters to the congress to possibly get a law against it. They could take it to courts if they really wanted to.

Gerrymandering is when a political power with the majority of the power redraws the district lines to keep voting numbers in their favor. It is done so that the party in question can stay in power for lengthy periods of time.
The process is legal but it is unconstitutional because this is done to benefit the politicians and not the people involved.
Gerrymandering is good for the politicians and them only, It does not offer fair representation because people are forced into districts where it's practically already decided for them.
The only way Gerrymandering can be stopped is if a law comes out making it illegal which is highly doubtful.
I find Gerrymandering selfish, it's just another way power hungry politicians show that they care more about their positions then the people who put them there.

In the process of setting electoral districts, gerrymandering is a practice that attempts to establish a political advantage for a particular party or group by manipulating district boundaries to create partisan advantaged districts. Gerrymandering is not illegal or unconstitutional. It is good for the political party's but is horrible toward the people because the representatives get to pick who votes for them. Gerrymandering can be good to an extent but I can also have a huge horrible effect on the people.

Gerrymandering is redrawing district maps to find friendly voters of the political party that assures the parties victory. It is not illegal or unconstitutional because the constitution leaves the drawing of districts to the individual states. Gerrymandering is beneficial to the political party that holds more power because that party can determine how the lines are drawn in their favor. People can make petitions and get enough signatures in order for it to be sent in front of the president. People can also write a letter to their state representatives stating their complaints. I think gerrymandering is bad because it does not offer fair representation to the people because they are placed in districts without a choice and that the legislatures are going to make the vote the way they want it, so no matter what the people want, the politicians will make the vote go in their favor. The politicians are choosing their voters more than the voters are choosing their politicians.

I believe that Gerrymandering is not constitutional but it is not illegal because there is truly no way to regulate this unless one comes up with one. Maybe the Math scientists should make it so that the areas are equal population so that they could be made an equal opportunity to win voters over. Although this is not a truly fair no matter how this is made but to be it is never fair. Maybe a totally new way should be made for voting in the house so that we don't have Gerrymandering.

1) Gerrymandering is the process of manipulating districts borders to have more people be in favor of your party in your area.
2) Currently Gerrymandering is not illegal but many people want it to be.
3) Gerrymandering is only good for the politicians, they only do it to get re-elected while it has no benefit to regular people.
4) I don't think it gives people fair representation because people can not choose which district they are in, so if most people are democrats in their district but they are republican there is nothing they can really do about it.
5) It could be stopped by many people getting together trying to make a law against it. If enough people agree to make it illegal it would be stopped.
6) I think gerrymandering is a bad thing because like i said before it gives people no say in what district they are in and if the majority of the district is the opposite party they will not be able to do much about who will be elected.

Gerrymandering is the purposeful manipulation of the district borders for party votes and supports. This act is legal at the moment but seems very unconstitutional to me. Gerrymandering will almost always benefit just one party; in saying that, sometimes these benefits aren't for the people. This act does not allow for fair representation to the needs and thoughts of the people in a certain area. To stop this we can vote on this. at the least for it to be reviewed by the supreme court; who will hopefully state it unconstitutional. I think that the only time gerrymandering would be good, is if it's in the best interest of the people, and I don't think that these constant border changes are because the people are moving house to different areas.

Gerrymandering is working district lines to favor one party over the other. These lines create strange shapes and do not represent the people in one area well. Their is nothing that specifically states that gerrymandering is illegal, although general public's opinion believes that it should be. Gerrymandering often benefits the party that controls the State Legislature of a specific state. By gerrymandering districts, a specific district can be packed with voters for one party, ensuring a seat in the House. They can also spread out the opposing parties voters, making it more likely they will win that district. In some ways it helps represent people, such as when districts are gerrymandered so one district is comprised of mostly a minority population, giving them more of a say. Having said that, gerrymandering does not represent people well on the geographical level. People in the same area will mostly want the same thing for their area, regardless of political affiliations. Representatives can't represent a group of people that live close together though with gerrymandered districts because their districts often cover a lot of distance - the ends of a gerrymandered district sometimes reach 100 miles apart. Gerrymandering can be prevented if people write to their representatives (a little ironic) and ask for a law to be made that prevents gerrymandering and sets out specific rules for how district lines can be drawn. It shouldn't be allowed, and instead districts should be equal in population and be compact areas that are as close to rectangular as possible.

Gerrymandering is making district in favor of a political party so they can win the district. I don't think it is unconstitutional but I believe that the districts should have to stay for 10 years then they should either be redrawn or kept the same way. Gerrymandering is good for the party that the districts help. No there is not fair representation because the lines are getting redrawn so there is never a fair representation. People can stop this by protesting taking it to court. I think this should be stop so there always an equality and that the election is fair and no one can change the outcome of the election.

Gerrymandering is the term they give to the practice of redrawing voting districts in favor of or against a political party. Whether it is constitutional or not is really not for me to decide. I'm no interpreter of the constitution so any input I have is inaccurate. I will say that I think it is constitutional, it has been done for years now and hasn't been declared unconstitutional so far so I have no reason to believe it's not. Gerrymandering obviously benefits the politicians drawing them otherwise they wouldn't be doing it. But I think a case can be made for it also representing the people. The video said that the politicians are choosing their voters rather than the voters choosing their politicians. This may be true in a sense but the voters are still voting and still putting there input in. Whether it's in the reddest or bluest distract they're still the reason the representatives have jobs. They're drawing the districts according to the people so there has to be a benefit somewhere. They're creating these districts full of people who are all for the same cause that they're representing, so they're being accurately represented, how is that not beneficial. Now obviously there is going to be a minority not represented but that is a problem that exists anyway with or without gerrymandering. I think drawing the districts based on population and geography could also have its problems. With gerrymandering you have these districts with a huge majority and a tiny minority with the majority being accurately represented, but with an evenly laid out district you get these more evenly matched majorities and minorities so with any given district you're going to have a larger minority not represented. I don't know if any of this makes sense but that's kind of how I feel. Gerrymandering is some sort of problem though, the fact that you are having us write about it means its enough of a point not to be. Whether it's a bad thing or not I don't know. Depends on whom you are asking.

3) Gerrymandering is great for the group drawing the line because they stay in power, but no one else is benefited from it.

5) One way to stop this is someone write a bill and present it to congress to set up rules for drawing district lines

Gerrymandering is where a political party redraws districts lines to give the party an advantage. It is not illegal or unconstitutional ( or else it wouldn't exist today), but I still find it to be unfair. They provide a huge benefit to a major political party, but leaves unfair representation among the people trying to vote. I believe Gerrymandering is a bad thing, because it makes the people not have any representation in a government.

1) Gerrymandering is more of the less a system used to draw more voters in towards the certain parties. These certain parties go around and draw around the district maps to bring people into their party.
2) This is not illegeal or unconstituional for the parties.
3) Gerrymandering is good for the parties that draw around certain part of the individual states. This is good for them because they have the option to only choose the ones and they know will forshur be on their side and dont have people that they dont need. As long as they keep drawing and taking in worth people in the individual states, they will keep winning.
4)No it does not offer fair representation because both parties will never have equal representation. One of the groups will always have more.
5) Gerrymandering can be stopped by setting up a system where the parties cant draw around the people the dont need. By setting up this system everyone will have the equal representation that they all want. people can void against gerrymandering and try to fight for their rights.
6)yes, jerrymandering is a bad thing becuase noone feels their representation that is needed to be a citizen. Overall it is a bad thing to be doing and should be fixed.

1. Gerrymandering is when politicians change state districts in order for their political party to win seats in Congress.
2. It is not unconstitutional or illegal but it should be made that the district boundaries are made and will stay that way and cannot be changed any more so it is fair and equal to all.

4. I don't think it offers people fair representation because they have no say in what district they are put in nor can they control how the districts are drawn.
5. Gerrymandering could be made illegal if enough people say it should be illegal.
6. I think gerrymandering is unfair because both parties are not represented equal.

1.) Gerrymandering is when a political party i.e. (Republicans or Democrats) draw electoral district lines in order to gain an advantage.
2.) Gerrymandering is legal and constitutional .
3.) Gerrymandering is often best for the political party that controls the State Legislature, because they have the advantage of deciding between packing, cracking or kidnapping. They also can create as many safe districts as possible.
4.) It does not offer fair representation because the politicians are basically picking their voters and creating their ideal scenario.
5.) Gerrymandering has been going on ever since 1812, obviously if it could or should have been changed, some sort of action would have been taken by now.
6.) Gerrymandering does not represent all of the people's voices and votes it represents simply the politician's. Gerrymandering should be stopped it's taking away from our popular sovereignty.

1.) Gerrymandering is when district borders are manipulated to give an advantage to a particular political party.
2.) This is legal and it does not mention it in the Constitution.
3.) Gerrymandering is good for the political party that is currently in control so then they can alter these districts to make sure they keep their power.
4.) Gerrymandering does and it doesn't. It is good because sometimes a district is full of one political view so then that minority at least has a voice. However, it usually means that the party that is practicing Gerrymandering will still get the larger voice.
5.) People have the right to speak out against Gerrymandering and protest against it.
6.) I think Gerrymandering is a bad thing because it is not fair and it gives too much power to whatever political party that is currently in control.

It is not unconstitutional but in my opinion very illegal because it is basically a rigged vote

Gerrymandering is good for the political party that is in control and winning or in the lead of the election

No it does not offer fair representation because gerrymandering cuts out people that arent apart of that political party

Yes because it does not offer fair representation but it is very good thing for the political party that is in the lead or needs the votes.

Gerrymandering is when the state legislatures redraw the district lines to the advantage of the majority party.
Gerrymandering is not illegal or unconstitutional. For these reasons, it is allowed, and normal, in the United States.
Gerrymandering is good for the majority party, because it provides them a much greater chance to win elections in their districts.
Gerrymandering does not offer the people fair representation, because odds are, the majority party is going to continue to win, and the people won't have a fair chance to vote, because the district will be controlled by the majority party no matter what.
The people can stop Gerrymandering by starting petitions and trying to pass laws that could make Gerrymandering illegal.
I do believe Gerrymandering is a bad thing. It is unfair to the minority party, giving them a lesser chance to win the elections, and it's unfair to the people, not allowing them to have their fair say in government. Popular sovereignty is not being upheld with Gerrymandering. And for that reason, I hope it can be put to a stop in the near future.

Gerrymandering is when districts are re drawn by the government to even out voting. It is not unconstitutional but it is rigged in a way. It only helps the leading party so it is not fair representation.

2) No, its not illegal nor is it unconstitutional
3) This is better for the majority party because that party will get more people to join
4) I think that it doesn't offer fair representation. One party is favored while the other doesn't get as many opportunities
5) It's possible for it to become illegal if people vote for it to be.
6) No, I don't agree with Gerrymandering because its not fair and both parties should have an equal representation throughout a specific place.

1.Gerrymandering is when politicians change state districts. or redraw them.
2.No it is not illegal or unconstitutional.
3.this is good for the party that need more people to get their vote in a election.
4.Gerrymandering does not have fair representation because the politicians are like pickig up the vote that they get when the districts are not redrawn.
5.the people can change this and speak up and talk about how they feel.
6.I think gerrymandering is unfair because both parties are not represented equal.

It is when u redraw the district lines to support the state legislature views. This is unfair to a party of people who oppose the views at the time for they get put into districts that the party the state legislature favors will out number those they oppose.
